Terms of Service

1. Acceptance of Terms

By accessing or using cheapvideo.ai or app.cheapvideo.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

CheapVideo.ai provides an AI-powered video generation platform that enables users to create short-form videos for social media platforms such as TikTok. The Service is available on a credit-based, one-time payment model.

3. Eligibility

You must be at least 16 years old to use the Service. By registering, you confirm that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.

4. Account Registration & Marketing Consent

To access the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your credentials.

By creating an account, you agree to receive:

• Transactional emails (account confirmation, credit usage, invoices)
• Marketing emails about new features, promotions, and special offers
• Notifications about product launches and updates

You may opt out of marketing communications at any time via the unsubscribe link in any email or by contacting us at contact@fpsfish.com.

5. Credits and Payment

Access to video generation requires purchasing credits. All purchases are:

• One-time payments — there are no recurring subscriptions.
• Priced in USD.
• Processed by Stripe — a third-party payment provider. By purchasing, you agree to Stripe's terms of service.

Credit expiry: Credits expire according to the plan purchased (ranging from 1 week to 1 year). Expired credits are forfeited and cannot be refunded or extended.

Refund policy: Due to the digital and consumable nature of credits, all purchases are final and non-refundable once credits have been used. If you have not used any credits, contact us within 14 days of purchase and we will review your refund request on a case-by-case basis, as required under EU consumer law.

6. Acceptable Use

You agree not to use the Service to generate content that:

• Violates any applicable law or regulation
• Is defamatory, obscene, harassing, or hateful
• Infringes on intellectual property rights of third parties
• Contains explicit sexual content involving minors
• Spreads misinformation or constitutes deepfake impersonation without consent
• Is used for spam, phishing, or other malicious purposes

We reserve the right to suspend or terminate accounts that violate these rules without refund.

7. Intellectual Property

Your content: You retain ownership of any content (text, prompts) you submit to generate videos. By using the Service, you grant us a limited licence to process your inputs solely to provide the Service.

Generated videos: Videos generated by the Service are provided to you for personal and commercial use, subject to any applicable third-party licences (e.g., music, stock footage). You are responsible for ensuring your use of generated videos complies with platform terms (e.g., TikTok) and applicable copyright law.

Our platform: All rights in the Service, its design, and underlying technology remain with CheapVideo.ai.

8. Availability and Changes

We strive to maintain Service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. For significant changes affecting paid credits, we will provide reasonable advance notice.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that generated videos will meet your specific requirements or that the Service will be error-free.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CheapVideo.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 30 days preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Polish or EU law.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Poland.

If you are a consumer located in the EU, you may also use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.

12. Termination

You may delete your account at any time by contacting us at contact@fpsfish.com. Unused, non-expired credits are forfeited upon voluntary account deletion.

We may terminate or suspend your account immediately if you breach these Terms, without prior notice or liability.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on our website at least 14 days before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
